I. GENERAL CONDITIONS

 

OVEGA, and Tomate & Basilic refer in this document to proposals for Products and Services provided by the company:

This privacy policy defines and informs you of how OVEGA uses and protects the information you transmit to us, where applicable, when you use the services associated with the ovega.fr domain or the services available on mobile applications developed by the OVEGA teams.

Please note that this privacy policy may be modified or completed at any time by OVEGA, in particular to comply with any legislative, regulatory, jurisprudential or technological changes. In such a case, the date of its update will be clearly identified at the beginning of this document. These modifications commit the User as soon as they are online. It is therefore advisable that the User regularly consults this privacy and use of cookies policy to be aware of any changes.

By "Services" or "Products" this document refers to all Tools, Services and Products accessible online that are developed and offered by OVEGA whether they are available on the website or through mobile applications.

By "Personal Data" the present document refers to any data entered and/or uploaded by the user or automatically retrieved by the Services or Products during their use : text (email, name, message, ), images, files, location or any type of data.

 

II.USE OF YOUR PERSONAL DATA

You can generally use certain OVEGA services without providing any personal information about yourself. In any case, you are under no obligation to transmit this information to OVEGA.

However, in case of refusal, you may not be able to benefit from certain information or services that you have requested.  Therefore, in some cases, OVEGA may ask you to provide your name, first name, e-mail address, telephone number, company and position (hereinafter as your "Personal Information" named). By providing this information, you expressly agree that it may be processed by OVEGA, for the purposes indicated in point 2 below as well as for the purposes recalled at the end of each form.

In accordance with the Règlement Général sur la Protection des Données (General Data Protection Régulation) adopted by the European Parliament on 14 April 2016, and with the Loi Informatique et Libertés (Data Protection Law) of 6 January 1978 as amended, OVEGA informs you of the following:

1.     Identity of the data controller

The controller is the OVEGA company. Within the association it is Francisco Ortega who is in charge of supervising the OVEGA project and who must be contacted.

2.     Purposes of the processing

OVEGA may process your Personal Information:

(a) to provide you with the information or services you have requested (including creating a OVEGA account and accessing Tomate & Basilic services); and/or

(b) to collect information that enables us to improve our Site, products and services (including using cookies); and/or

(c) in order to contact you about various events related to OVEGA, including product updates and customer support.

3.     Recipients

Only OVEGA is recipient of your Personal Information. These, whether in individual or aggregated form, are never transmitted to a third party, notwithstanding the subcontractors that OVEGA uses (you will find more information about them in point 7 below). OVEGA never markets the personal data of visitors and Users of its Site.

4.     Storage life

Your Personal Information is kept by OVEGA only for the time corresponding to the purpose of collection as indicated in 2 above. The data used in the context of user accounts are kept indefinitely if the said account has not been deleted, and for a period of 24 months after the deletion of this account. All other information is kept for a maximum period of 24 months.

5.     Data Rights and Freedoms

You have the following rights concerning your Personal Information, which you can exercise by writing to us at the postal address mentioned in the I. LEGAL INFORMATION paragraph or at the following address: contact@ovega.fr.

5.1.             Right of access and data communication

You have the right to access Personal Information about yourself.

However, due to OVEGA's obligation of security and confidentiality in the processing of personal data, you are informed that your request will be processed on condition that you provide proof of your identity, in particular by producing a scan of your valid identity card (in the case of a request via our dedicated electronic form) or a signed photocopy of your valid identity card (in the case of a written request).

OVEGA informs you that it will be entitled, if necessary, to oppose manifestly abusive requests (by their number, their repetitive or systematic character).

5.2.             Right of data rectification

Under this right, legislation gives you the right to request the rectification, updating, blocking or deletion of data concerning you that may prove to be inaccurate, erroneous, incomplete or obsolete.

You can also define general and specific directives concerning the fate of personal data after your death. If necessary, the heirs of a deceased person may demand that the death of their loved one be taken into consideration and/or that the necessary updates be made.

5.3.             Right of opposition

The exercise of this right is only possible in one of the following two situations:

  1. Where the exercise of this right is based on legitimate reasons; or
  2. When the exercise of this right is intended to prevent the data collected from being used for commercial prospecting purposes. 6.     Response times

OVEGA undertakes to respond to your request for access, rectification or opposition or any other additional request for information within a reasonable period which may not exceed 2 months from receipt of your request.

7.     Authorised service providers and transfer to a third country of the European Union

OVEGA informs you that it employs its authorized service providers to facilitate the collection and processing of the data you have communicated to us. These providers may be located outside the European Union and have communication of data collected on our various services. OVEGA has previously ensured that its service providers have implemented adequate guarantees and that strict conditions regarding confidentiality, use and data protection are respected. In particular, vigilance has been focused on the existence of a legal basis for any transfer of data to a third country.

 

8.     Complaint to the competent authority

 

If you consider that OVEGA does not respect its obligations with regard to your Personal Information, you can address a complaint or a request to the competent authority. III.COOKIE POLICY (WEBSITE ONLY)
